KORVEN Performance sells automotive performance parts, accessories, components, and related products. We make every effort to accurately display and describe our products, but product images, colors, dimensions, finishes, specifications, and packaging may vary.

Product descriptions, pricing, availability, and specifications are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

SECTION 3 - OFF-ROAD USE ONLY AND MOTORSPORTS DISCLAIMER

Unless explicitly stated otherwise, products sold by KORVEN Performance are intended for off-road, racing, closed-course competition, exhibition, and motorsports use only.

Products intended for off-road or racing use should not be installed on or used with vehicles operated on public highways, public roads, public streets, or any other public roadway.

By purchasing from KORVEN Performance, you acknowledge and agree that certain products may alter vehicle emissions systems, safety systems, noise output, drivability, reliability, warranty coverage, inspection eligibility, smog compliance, registration status, insurance coverage, and street legality.

You are solely responsible for determining whether any product may be legally purchased, installed, used, or operated on your vehicle in your city, county, state, province, country, or jurisdiction.

KORVEN Performance is not responsible for citations, fines, failed inspections, failed smog checks, registration issues, warranty denials, insurance disputes, vehicle damage, property damage, personal injury, death, or any other consequence resulting from the purchase, installation, use, misuse, or illegal use of any product.

Motorsports, racing, high-performance driving, and vehicle modification involve inherent risks. You voluntarily assume all risks associated with purchasing, installing, tuning, operating, or using any product sold by KORVEN Performance.

SECTION 4 - EMISSIONS, CLEAN AIR ACT, AND CARB COMPLIANCE

Certain products sold by KORVEN Performance may not be legal for sale, installation, or use on pollution-controlled motor vehicles in California, other CARB-regulated states, or other jurisdictions with emissions laws.

It may be illegal under the Federal Clean Air Act, California Air Resources Board regulations, or other applicable laws to install, sell, offer for sale, advertise, or use aftermarket components that remove, bypass, defeat, disable, modify, or render inoperative emissions control systems unless the product has received an applicable exemption or approval.

KORVEN Performance does not guarantee that any product is legal for street use, emissions compliant, CARB approved, smog legal, inspection compliant, or suitable for use on any pollution-controlled vehicle.

Customers are solely responsible for verifying whether a product has a valid CARB Executive Order, emissions exemption, or other required approval before purchasing, installing, or using the product.

SECTION 5 - VEHICLE FITMENT RESPONSIBILITY

Vehicle fitment information is provided for convenience only and is not guaranteed. Customers are solely responsible for verifying compatibility before purchasing.

Before placing an order, you should verify your vehicle’s year, make, model, trim, engine, transmission, drivetrain, emissions equipment, modifications, and regional requirements.

KORVEN Performance is not responsible for incorrect fitment caused by customer error, vehicle swaps, custom modifications, aftermarket components, regional vehicle differences, or incomplete product research before purchase.

SECTION 6 - PROFESSIONAL INSTALLATION REQUIRED

Many products sold by KORVEN Performance require professional installation by a qualified technician, mechanic, tuner, fabricator, or automotive specialist.

KORVEN Performance is not responsible for damage, malfunction, failure, injury, or loss caused by improper installation, improper tuning, incorrect use, lack of maintenance, or installation by an unqualified person.

Installation instructions, when provided, are for general guidance only and do not replace professional judgment.

SECTION 7 - TUNING AND PERFORMANCE DISCLAIMER

Certain products may require ECU tuning, supporting modifications, calibration, break-in procedures, or professional adjustment.

KORVEN Performance does not guarantee horsepower gains, torque gains, sound changes, fuel economy improvements, reliability improvements, track performance, drivability, emissions compliance, or any specific performance outcome.

Any performance claims, dyno numbers, or advertised results are estimates only and may vary based on vehicle condition, fuel quality, tuning, climate, elevation, supporting modifications, installation quality, and other factors.

SECTION 8 - ORDERS

When you place an order, you are making an offer to purchase. KORVEN Performance reserves the right to accept, decline, modify, or cancel your order for any reason.

Your order is not accepted until payment has been processed and we confirm acceptance. We may be unable to accommodate cancellation requests once an order has been processed, shipped, or submitted to a supplier.

Your purchases are subject to our Refund Policy.

You agree that your purchase is not for unlawful use, unauthorized resale, or illegal export.

SECTION 9 - PRICES AND BILLING

Prices, discounts, promotions, and availability are subject to change without notice.

Posted prices do not include taxes, shipping, handling, customs duties, import charges, brokerage fees, or other fees unless expressly stated.

We reserve the right to correct pricing errors, product errors, or availability errors at any time, including after an order has been submitted.

Once products are transferred to the shipping carrier, title and risk of loss pass to you.

Customers are responsible for all customs duties, taxes, import fees, brokerage fees, and other charges imposed by their local government or carrier.

SECTION 11 - BACKORDERS, SPECIAL ORDERS, AND PRE-ORDERS

Certain products may be special order, made-to-order, imported, backordered, or pre-order items.

These items may require extended processing, manufacturing, or shipping time. Estimated timelines are not guaranteed.

Special order, custom, used, installed, electrical, opened, or made-to-order items may be non-cancelable and non-refundable unless required by law or approved by KORVEN Performance.

SECTION 12 - RETURNS AND REFUNDS

Returns, exchanges, cancellations, and refunds are governed solely by our Refund Policy.

Products that have been installed, used, modified, damaged, altered, tuned, painted, welded, cut, or otherwise changed from original condition may not be eligible for return.

Shipping costs, customs fees, duties, brokerage fees, and installation costs are not refundable unless required by law.

SECTION 13 - MANUFACTURER WARRANTIES

KORVEN Performance does not provide independent product warranties unless expressly stated in writing.

Any warranty, if available, is provided solely by the product manufacturer and is subject to that manufacturer’s terms, limitations, and approval process.

KORVEN Performance is not responsible for manufacturer warranty denials, labor costs, installation costs, tuning costs, diagnostic fees, rental vehicles, towing, downtime, or consequential damages.

SECTION 14 - INTELLECTUAL PROPERTY

All content on the Services, including logos, names, text, images, graphics, videos, designs, product descriptions, and other materials, is owned by KORVEN Performance, its affiliates, suppliers, or licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, copy, download, display, transmit, or exploit any part of the Services without our prior written consent.

SECTION 15 - THIRD-PARTY LINKS AND TOOLS

Our Services may include third-party tools, links, apps, payment processors, shipping providers, or embedded functionality. We do not control and are not responsible for third-party services.

KORVEN Performance is powered by Shopify. However, all purchases are made directly with KORVEN Performance.

You acknowledge and agree that Shopify is not responsible for any aspect of your transaction with KORVEN Performance, including any injury, damage, loss, claim, or dispute arising from products purchased through our store.

You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to purchases made from KORVEN Performance.

SECTION 22 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, KORVEN PERFORMANCE, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, VEHICLE DAMAGE, ENGINE DAMAGE, TRANSMISSION DAMAGE, TURBO FAILURE, EMISSIONS FAILURE, FAILED INSPECTION, WARRANTY DENIAL, REGISTRATION ISSUE, INSURANCE DISPUTE, LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, LABOR COSTS, TUNING COSTS, DIAGNOSTIC COSTS, TOWING COSTS, RENTAL VEHICLE COSTS, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED FROM KORVEN PERFORMANCE.

IN ALL CASES, OUR MAXIMUM LIABILITY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 23 - INDEMNIFICATION

You agree to release, defend, indemnify, and hold harmless KORVEN Performance, Shopify, and our affiliates, partners, owners, officers, directors, employees, agents, contractors, suppliers, licensors, and service providers from any claims, losses, damages, liabilities, penalties, fines, costs, or expenses, including reasonable attorney fees, arising out of or related to:

4. Any off-road, racing, motorsports, or public road use of any product;

5. Any emissions, smog, inspection, registration, insurance, or legal issue related to any product;

6. Any vehicle damage, property damage, personal injury, or death related to any product;

7. Your violation of the rights of any third party.

SECTION 24 - CALIFORNIA RESIDENTS

If you are a California resident, you acknowledge and agree that certain products may be subject to California emissions laws, CARB regulations, Proposition 65 warnings, and other state-specific requirements.

Where applicable, products may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.

California customers are solely responsible for determining whether a product is legal for sale, installation, and use in California before purchasing.

SECTION 25 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, the unenforceable portion shall be severed, and the remaining provisions shall remain valid and enforceable.

SECTION 26 - WAIVER; ENTIRE AGREEMENT

Failure by KORVEN Performance to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies referenced herein, constitute the entire agreement between you and KORVEN Performance regarding your use of the Services.

SECTION 27 - ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations without notice or consent.

We shall not be liable for delays or failures caused by events outside our reasonable control, including natural disasters, labor disputes, supply chain disruptions, carrier delays, customs delays, war, terrorism, government actions, internet outages, cyberattacks, or other events beyond our control.

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website.
